  1. Borland vs Smantec, a case of E-mail privacy

  4. Last September (1992) a Borland employee, a highly placed employee at that, defected to Symantec. Borland thinks Vice President Eugene Wang gave his future boss, Gordon Eubanks, CEO of Symantec, trade secrets in anticipation of relocating to Symantec.

  6. What happened?
  7.    Wang, days before he made the move to leave Borland for Symantec sent MCI Mail to his new boss Eubanks containing:
  8.       . Marketing plans
  9.       . Customer lists
  10.       . Future product strategies
  11. The MCI Mail account was a master account belonging to Borland for which employees have separate passwords and mail boxes. Wang had his own password and mail box.

  13. How did Borland get the goods on Wang?
  14.    Borland used Wang's password to retrieve his mail-sent which was still being held online.
  15.    Also, it appears that Wang had trashed a number of files from his computer. Borland, using proprietary software, recovered the data that Wang had tried to trash.

  17. Events:
  18.    Borland called the District Attorney to investigate and a judge issued search warrants to go into the homes of Wang and Eubanks looking for evidence. This investigation continues.
  19.    Borland filed a Civil suit against Wang, Eubanks, and Symantec.
  20.    Wang, Eubanks, and Symantec have filed a counter suit against Borland. The counter suit is based on Defamation.
  21.    Both Eubanks and Wang have taken the Fifth Amendment and declined to answer questions in the Civil suit on the grounds that it may incriminate them in the event of a Criminal indictment.

  23. Expensive dispute:
  24.    It is rumored that Symantec has spent $1.6 Million Dollars to defend the suit and press a counter suit.
  25.    Borland has insurance that covers a suit for defamation.

  27. Bit Players:
  28.    Art Danner, Santa Cruz District Attorney, is conducting a criminal investigation. Are Felony charges forthcoming? Or is this matter limited to a Civil disbute?
  29.    Jim Pooley, Attorney for Wang, has no comment, but in a legal article back in 1985 he claimed that trade secret law was melange of case law. Some think it has been made clearer in recent years.
